Due to what an investigation said was the threat of "serious injury or death" to officers, two Benton County law enforcement officers have been cleared in a non-fatal shooting in July.

Deputy Scott Surplus, and Commander Jon Law responded to a July report of a man at a home on West 26th, and the man reportedly had a weapon. It was a domestic violence call.

The suspect, 56-year-old Robert Bevel, refused to drop a shotgun when ordered by the officers. Surplus shot him in the shoulder, and he was dropped by a non-lethal round from Commander Law.  Authorities had responded to several calls to the residence already over the weekend, culminating with the final incident July 25th.
