In 2012, the Washington State Supreme Court ruled the way the state legislature funded education was "unconstitutional."  This became known as the McCleary Decision. Again this year, the legislature must provide a "progress report" to the Court - it's expected next week.

The court had held the legislature in "contempt," a move that some legal experts said was not "legal."  They say because of separation of powers built into the state government, the Court cannot legally, directly, tell the House and Senate what to do.

But the decision was handed down, and we are now dealing with it.  The court ruled the legislature must "fully fund" education by the year 2018, and each session, the House and Senate must find a way to do it. They also have to provide a progress report to the court.

  Despite possibly having to go into a special legislative overtime session, lawmakers say they will ensure the necessary funding is passed to meet the McCleary standards.
