It likely violates the 14th Amendment, for starters, but also raises serious OSHA issues for businesses as well.

Gov. Inslee is treading into dangerous waters, and a well-known watchdog group is prepared to sue him over his latest covid vaccine passport program.

While Inslee has been touting the 'perks program' of getting vaccinated with its additional 'freedoms' such as vaccinated sections, the dark side is being hidden.

May 21st, orders went out to Labor and Industries, reports the Washington Policy Center, that businesses must have their vaccination records of employees available so it can be determined who can go without a mask, and who cannot. Also applies to social distancing. L-I will be tasked with checking for 'vaccine passports' in businesses.

The WPC has an excellent piece about how this violates the 14th Amendment of the Consitution, which says:

“No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

The L-I rules do not allow for religious, medical, or other personal exemptions. And, Labor and Industries in some cases, is required to mark on worker's badges if they are vaccinated which creates an unfair discriminatory workplace.

WPC reports, as have others, that this creates a situation where businesses are essentially forced to discriminate against workers who choose not to get the vaccine.

Now the Freedom Foundation is prepared to sue Inslee. In a statement released Monday, Aaron Withe, CEO, said this in part:

“Jay Inslee’s continued abuse of Washingtonians is an outrage. He dragged his feet for months, ignoring the science and delaying reopening our state, but now that he’s run out of excuses to keep people locked down, he is going to punish business owners and employees who want to get back to normal by forcing them to divulge their private health information to their coworkers by their behavior in the workplace."

He continued:

“So Gov. Inslee is forcing business owners to decide whether they allow their employees to make their own healthcare decisions or force them into a position of liability with OSHA?"

Withe mentioned the Freedom Foundation was the first to sue over using state agencies to shut down businesses to force them to comply with his edicts, and he also said this:

“He has behaved like an out-of-touch king throughout this whole COVID pandemic . But now he’s just become a tyrant drunk on emergency power, and we’re prepared to sue him over this vaccine passport, too.”
