According to a King County Superior Court Judge, the law that would have required a super majority vote on tax increases by the House and Senate is against the State Constitution.

According to KING-5 TV in Seattle:

"A judge says Tim Eyman's latest anti-tax measure is unconstitutional and void in its entirety.

King County Superior Court Judge William Downing issued his ruling on Initiative 1366 on Thursday. The measure, approved by voters in November, would have cut the sales tax by one percentage point, beginning in April, unless the Legislature allows a public vote on an amendment that would require a two-thirds supermajority for future tax increases."

Eyman's opponents used the argument that the initiative supposedly contained TWO subjects, because it stipulated if the legislature failed to forward a Constitutional amendment for the super majority to voters on the ballot this year, the state's sales tax would be lowered by 1 percent. The League of Women Voters, along with Democrats, argued the initiative also contained the super majority vote, which made for the two subjects. The Constitution requires initiative only have one.

Eyman said his attorney and he carefully studied the idea before filing for the initiative and it IS legal. He is still urging the legislature to go ahead with the idea, and he does plan to take it to the State Supreme Court and appeal.

If I-1366 is eventually defeated and overturned, it will be the sixth time such a two-thirds measure has been passed by voters, only to see it challenged and done away with.

Maybe the folks in Olympia just aren't getting the message from voters? People are getting tired of reckless, wasteful spending.
