According to a new Freedom Of Information Act lawsuit filed by Judicial Watch, the Department of Homeland Security dropped the ball, and possibly covered up a serious incident involving the death of an American citizen.

An illegal named Carlos Martinelly-Montano from Bolivia, was officially placed in the custody of ICE  (Immigration and Customs Enforcement) last year, but his deportation hearing was delayed three times, and he was eventually released.  He was later arrested and indicted in a DUI case that resulted in the death of Sister Denise Mosier and the injury of two other nuns. Montano was intoxicated while driving in Prince William County VA. The accident occured in August 2010.

 Montano had previously been arrested for DUI in 2008, which is why he was in ICE custody.  Judicial Watch claims botched policy and procedures by the Department of Homeland Security and a deliberate coverup of that failed event led to the eventual death of an American citizen.  Judicial Watch is seeking any and all documents, correspondances, and paperwork related to the Montano case.  Judicial Watch and other law enforcement officials say this is not uncommon--numerous illegals are arrested for a crime, placed in custody, then released...only to reoffend.
